1. General Provisions
1.1. Data Controller Information
This Privacy Policy (hereinafter – the “Policy”) has been developed in accordance with the applicable legislation of Ukraine, including but not limited to the Law of Ukraine “On Personal Data Protection” dated June 1, 2010, No. 2297-VI (hereinafter – the “Law”), taking into account the principles and rules of the General Data Protection Regulation (GDPR) of the European Union with respect to Users, and establishes the procedure for processing personal data, including but not limited to: collection, accumulation, storage, modification, use, distribution (transfer, exchange, disclosure), destruction, and protection, including through information (automated) systems (hereinafter – “Data”), via the website https://biome-psychobiotic.com.
The Data Controller is HUNKO OKSANA VOLODYMYRIVNA (RNOKPP/EDRPOU 3445900461).
1.2. Moment of Consent to Data Processing
By submitting a request and entering personal Data and/or providing such Data by other means at their own initiative, the User expresses their agreement with the provisions of this Policy and grants permission for the processing of their Data.
1.3. Sources of Data Collection
Users may provide Data independently by communicating via telephone and/or email and/or postal address, by completing questionnaires (filling out forms or by other means), or Data may be provided from other sources (in accordance with Section 3 of this Policy), for example, from User reviews (ratings, comments, information confirmations) or other information from third parties provided in the course of submitting claims, complaints, and/or during dispute resolution, and/or information from publicly available sources on the Internet.
2. Composition of Data Processed
2.1.
Data means any information that directly or indirectly relates to a specific User.
2.2.
BIOME PSYCHOBIOTIC may collect the following Data:
• Full name (first name, last name, patronymic, if applicable), other contact details at the User’s discretion (e.g., place and/or work address), payment card numbers, payment card tokens;
• Information about the User’s account, including login, phone number, email address, account processing data, and other Data necessary for servicing BIOME PSYCHOBIOTIC Users, communicating with Users including during User contact with BIOME PSYCHOBIOTIC support, and other information provided by the User at their discretion when completing the User’s Personal Account on BIOME PSYCHOBIOTIC;
• Information provided by Users to BIOME PSYCHOBIOTIC when entering into service agreements through acceptance of a public offer;
• Information necessary for communication between Users, including for executing and confirming transactions between sellers and buyers, sending and receiving messages, posting reviews and comments, making payments, fulfilling User requests and receiving feedback when necessary, information posted by Users as a result of their service experience, reviews, comments, customer support inquiries, complaints, claims, and other appeals;
• Device data (computer, browser type, mobile device operating system) used by Users, information about User websites and/or their mobile data (if the User uses mobile applications) such as: IP address; date and time of User activity on BIOME PSYCHOBIOTIC; information about the software and internet browser used by the User; information about the mobile device operating system; information about device performance; unique device identifiers used by Users;
• Information received by BIOME PSYCHOBIOTIC as a result of marketing activities; other information used for communication, provided by the User at their discretion;
• Information about User actions on BIOME PSYCHOBIOTIC (consumer behavior regarding purchased goods, works, and services (browsing history, search queries, purchases, product interactions), information about communication with other Users, including information left by Users in chat (including chatbot), review forms, ratings, comments, or any other User feedback; information used to form User ratings, containing user experience left by Users on BIOME PSYCHOBIOTIC as a result of interaction with other Users, enabling BIOME PSYCHOBIOTIC to take necessary measures to maintain service quality and prevent fraud, and messages (information contained in correspondence between Users and in correspondence with the Administration);
• Information posted or provided to Users in the course of their participation in loyalty programs, quizzes, promotions, and special offers conducted on BIOME PSYCHOBIOTIC and organized by BIOME PSYCHOBIOTIC;
• Information received from Users by completing questionnaires or otherwise communicated to the BIOME PSYCHOBIOTIC Administration (this may include, but is not limited to: citizenship, place of birth, education, profession, specialization, work experience, social status, family composition (last names, first names, patronymics of such persons, their gender, age, registration and residence address, contact details), photos, video images of the User (and/or the User’s authorized representative, etc.);
• Information obtained during verbal communication between the User and the BIOME PSYCHOBIOTIC Administration; information provided during payment and/or the User’s use of any service provided by BIOME PSYCHOBIOTIC; information lawfully obtained by BIOME PSYCHOBIOTIC from related persons (partners), counterparties, and/or other third parties.
2.3.
BIOME PSYCHOBIOTIC does not process special categories of personal data (so-called “sensitive data”) relating to racial, national, or ethnic origin, political views, religious or other beliefs, membership in political parties and/or organizations, trade unions, religious organizations, or other public organizations. Information characterizing the physiological characteristics of Users, on the basis of which their identity can be established, is also not processed.
2.4.
The Company may process Data using the following technologies and services:
• Cookies – small pieces of Data sent to the User’s computer when visiting a webpage and/or viewing an advertising module on a webpage, stored on the User’s computer and/or mobile device;
• Pixel files – digital images, display matrix elements that form images, allowing tracking of the frequency of User webpage visits to identify the User’s browser and provide services, such as retaining Data in the cart between visits; as well as to eliminate BIOME PSYCHOBIOTIC errors initiated by the User, while all information is processed “as is” and is not altered during Data collection;
• reCAPTCHA – a Google service for protecting webpages from bots through image recognition, more details at: https://developers.google.com/recaptcha/intro;
• Google Analytics – a Google service used to collect analytics on User visits to Marketplace pages, more details at: https://developers.google.com/analytics;
• Gemini API, Google AI Studio – provided directly by Google and/or through an intermediary.
3. Purpose of Data Processing
3.1.
The Company uses and processes Data for the following purposes:
• Fulfillment of the functions, powers, and obligations assigned to BIOME PSYCHOBIOTIC in accordance with applicable Ukrainian legislation, as well as ensuring civil, commercial, and tax relations;
• Identifying the client as a BIOME PSYCHOBIOTIC User; communicating with the User including for service delivery, payment processing, shipping, settlement operations, reporting, bookkeeping and management accounting, creating and implementing loyalty and bonus programs, sending mailings by post, email, and phone number, including for the purpose of sending commercial offers, promotional notifications, loyalty program information, and news regarding BIOME PSYCHOBIOTIC’s operations, as well as other marketplaces/websites under the management and/or ownership of BIOME PSYCHOBIOTIC, and/or to notify BIOME PSYCHOBIOTIC Users about financial services provided by third parties and/or partners; improving service quality, forming ratings, analyzing User activity, conducting keyword searches, managing traffic on BIOME PSYCHOBIOTIC, analyzing and forecasting User preferences and interests; conducting research and analytical activities, as well as ensuring compliance by Users with the User Agreement, the Rules for Posting Information on BIOME PSYCHOBIOTIC, and the Review Publication Rules;
• Ensuring the provision of BIOME PSYCHOBIOTIC internet services available on Seller Websites, information exchange, creating interest profiles, and providing Users in search results and through other technical solutions and algorithms available on the Marketplace with the most relevant products, offers, and content on BIOME PSYCHOBIOTIC;
• Providing answers to frequently asked questions received via chatbot or for preliminary processing of User requests before transferring them to a support staff member and/or other employees. Data entered by the User during chatbot interactions may be analyzed by an AI system to provide responses and select/recommend the most relevant products based on the request;
• Training and improving artificial intelligence algorithms, enabling more accurate recommendations and quality support for BIOME PSYCHOBIOTIC Users;
• Displaying Data specified by BIOME PSYCHOBIOTIC Buyers, posted directly on Seller Websites created on the platform.
4. Conditions for Granting Access to Data
4.1. Disclosure of Data may occur to:
4.1.1. BIOME PSYCHOBIOTIC employees who need to work with such Data to fulfill their employment and functional duties;
4.1.2. Related persons of BIOME PSYCHOBIOTIC, partners, and counterparties where appropriate and necessary to achieve the purposes set out in this Policy;
4.1.3. Other BIOME PSYCHOBIOTIC Users and their authorized persons when placing orders, to the extent necessary to identify the Buyer/Seller and such orders;
4.1.4. Upon substantiated requests from state authorities and other authorized bodies entitled to request and receive such Data;
4.1.5. In cases where BIOME PSYCHOBIOTIC has reasonable grounds to suspect a User’s violation of the terms of this Policy and/or other agreements concluded between BIOME PSYCHOBIOTIC and the User, as well as the provisions of the User Agreement, the Rules for Posting Information on BIOME PSYCHOBIOTIC, the Review Publication Rules, the Product Listing Rules, and the Advertisement Placement Rules.
4.2.
The BIOME PSYCHOBIOTIC website provides the ability to arrange delivery of Buyer orders by transferring the necessary information to the relevant delivery services.
4.3.
BIOME PSYCHOBIOTIC reserves the right, in accordance with the requirements of applicable Ukrainian legislation, to exchange Data with state authorities for the purpose of: fraud prevention; resolution of disputes and clarification of circumstances that are or may become the cause of violations of applicable legislation, as well as in cases where BIOME PSYCHOBIOTIC identifies unlawful actions by Users and/or receives claims, complaints, or appeals from third parties.
5. User Rights as Data Subjects
5.1. In accordance with Article 8 of the Law, the User has the right to:
5.1.1. Know the sources of collection, the location of their Data, the purpose of its processing, the location and/or place of residence (stay) of the Data controller or processor, or to give an appropriate instruction to obtain this information to authorized persons, except in cases established by the Law;
5.1.2. Receive information about the conditions for granting access to Data, including information about third parties to whom their Data is transferred;
5.1.3. Access their Data;
5.1.4. Receive, no later than 30 (thirty) calendar days from the date of the request, except in cases provided by the Law, a response as to whether their Data is stored, as well as to receive the content of their Data;
5.1.5. Submit a motivated demand to the Data controller objecting to the processing of their Data;
5.1.6. Submit a motivated demand for the modification or deletion of their Data by any Data controller or processor, if such Data is processed unlawfully or is inaccurate;
5.1.7. Protection of their Data from unlawful processing and accidental loss, destruction, or damage due to intentional concealment, non-provision, or untimely provision, as well as protection from the provision of information that is inaccurate or that defames the honor, dignity, and business reputation of an individual;
5.1.8. File complaints regarding the processing of their Data with the Ukrainian Parliament Commissioner for Human Rights or with a court;
5.1.9. Apply legal remedies in the event of a violation of data protection legislation;
5.1.10. Make reservations regarding the restriction of the right to process their Data when providing consent (to the extent that this is implemented);
5.1.11. Withdraw consent to Data processing;
5.1.12. Know the mechanism of automated Data processing;
5.1.13. Protection against an automated decision that has legal consequences for them.
6. Modification/Deletion of Data and Withdrawal of Consent to Data Processing
6.1.
Upon receipt of such notification, the processing of the User’s Data will be terminated, and their Data will be deleted, except in cases where such processing may be required under applicable Ukrainian legislation and except as provided in clause 6.5.1 of this Policy.
6.2.
The functioning of certain features that require User information will cease from the moment of Data modification/deletion or processing of the request to withdraw consent to Data processing.
6.3.
BIOME PSYCHOBIOTIC processes and stores Data to achieve the purposes specified in this Policy for the entire period necessary for such purposes, but no longer than 5 (five) years from the date of the User’s last interaction with BIOME PSYCHOBIOTIC. In any case, the periods of Data processing and storage are determined based on the purposes of Data processing, taking into account the terms specified in agreements concluded with Users in accordance with applicable Ukrainian legislation.
7. Procedure for Handling User Requests Regarding Access to Their Data
7.1.
The User has the right to obtain information about the processing of their Data by the Company. The Request shall indicate:
• Last name, first name, and patronymic, place of residence (stay), and details of the document certifying the User’s identity;
• Information about the Data to which the Request relates, namely the list of personal data being requested;
• The purpose and/or legal grounds of the Request;
• The date and signature of the person submitting the Request.
7.3.
The Request shall be fulfilled within 30 (thirty) calendar days from the date of its receipt, unless otherwise provided by law.
8. Data Protection Measures
8.1.
BIOME PSYCHOBIOTIC, when processing Data, applies all necessary technical, organizational, and legal measures to protect Data from unlawful and/or unauthorized access, including modification, deletion, disclosure, dissemination, and other unlawful actions.
8.2.
BIOME PSYCHOBIOTIC continuously monitors the measures taken to ensure security.
9. Additional Terms
9.1.
BIOME PSYCHOBIOTIC reserves the right to amend the terms of this Policy at any time. In such case, the updated version will be published at: https://biome-psychobiotic.com/politika-konfidenciynosti-saytu. The User may not use the BIOME PSYCHOBIOTIC website if they do not agree with the terms of this Policy. If the User does not agree with the changes, they are obliged to immediately cease all use of the Marketplace.
9.2.
The Company shall not be liable for any harm or damages suffered by the User or third parties as a result of misunderstanding or failure to understand the terms of this Policy.
The User acknowledges that in the event of their negligent attitude toward the security and protection of their Data (including authorization credentials (password, login) and devices used to work with the Company’s systems), third parties may gain unauthorized access to the User’s Personal Account and Data. BIOME PSYCHOBIOTIC shall not be liable for damages caused by such access.
9.3.
BIOME PSYCHOBIOTIC shall not be liable for the processing of Data carried out by Users in relation to one another during interaction and/or through the Website. Each User bears personal responsibility for the lawfulness and security of processing the Data of other persons with whom they interact, including but not limited to the collection, storage, transfer, and use of such Data. Users are obliged to independently ensure compliance with personal data protection legislation during such interactions.
9.4.
Should any provisions of this Policy, or clauses or parts thereof, be found to conflict with applicable Ukrainian legislation or be deemed invalid, this shall in no way affect the other provisions of this Policy, which shall remain fully in force and continue to operate to their full extent and be deemed valid; and any other invalid or unenforceable provision shall, without further action by the Parties, be deemed amended and corrected to the extent necessary to ensure its validity and enforceability.
9.5.
Terminology used in this Policy shall have the same meaning as in the User Agreement, unless otherwise specified.
9.6.
In all other matters not provided for or defined in this Policy, BIOME PSYCHOBIOTIC and the personal data subject shall be governed by the norms and requirements of the Law.
