This Agreement constitutes an official and public offer of the Seller to enter into a sale and purchase agreement for the Goods presented on the website https://biome-psychobiotic.com.

This Agreement is public, meaning that in accordance with Article 633 of the Civil Code of Ukraine, its terms are equal for all Buyers regardless of their status (individual, legal entity, or sole proprietor), without granting preference to any Buyer over another.

By entering into this Agreement, the Buyer fully accepts the terms and conditions regarding order placement, payment, delivery, returns, liability for bad-faith orders, and all other provisions of this Agreement.

The Agreement is deemed concluded at the moment the Buyer clicks the “Confirm Order” button on the checkout page in the “Cart” section and receives an electronic confirmation of the order from the Seller.

1. Definitions

1.1. Public Offer (hereinafter – the “Offer”) – a public proposal of the Seller addressed to an indefinite number of persons to conclude a distance sale and purchase agreement (hereinafter – the “Agreement”) under the terms contained in this Offer.

1.2. Goods or Service – the subject matter of the transaction selected by the Buyer on the Online Store website and placed in the cart, or already purchased by the Buyer remotely.

1.3. Online Store – the Seller’s website at https://biome-psychobiotic.com created for concluding retail and wholesale purchase agreements based on the Buyer’s review of the Goods description via the Internet.

1.4. Buyer – a legally capable individual who has reached the age of 18 and places orders for personal purposes not related to business activities, or a legal entity / sole proprietor.

1.5. Seller – Sole Proprietor OKSANA HUNKO (Tax ID 3445900461), address: Ukraine, Vinnytsia region, Turbiv, 44 Ivana Franka Street.

2. Subject of the Agreement

2.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement.

2.2. The Agreement is deemed concluded when the Buyer submits the order form and receives confirmation.

3. Order Placement

3.1. The Buyer places an order via the website, email, or phone.

3.2. The Seller may refuse an order if information is incomplete or unreliable.

3.3. Required information:
- full name
- delivery address
- phone number
- tax ID (for legal entities)

3.4. Product details are shown in the cart.

3.5. Additional info may be requested.

3.6. Buyer is responsible for data accuracy.

3.7. By placing an order, the Buyer agrees to personal data processing.

4. Price and Delivery

4.1. Prices are in UAH including VAT.

4.2. Prices may change except for paid orders.

4.3. Delivery is paid separately.

4.4. Payment is completed upon receipt of funds.

4.5. Buyer inspects goods upon delivery.

4.6. Ownership transfers upon delivery.

5. Rights and Obligations

Seller must deliver goods and protect data.
Seller may change terms.
Buyer must provide accurate info.

6. Returns

6.1. Returns allowed within 14 days if unused.

6.2. Refund within 30 days.

6.3. Refund via bank transfer.

6.4. Return shipping paid by Buyer.

6.5. Defects handled per law.

7. Liability

7.1. Seller not liable for misuse.

7.2. Seller not liable for incorrect data.

7.3. Force majeure applies.

8. Data Protection

8.1. Buyer consents to data processing.

8.2. Data not disclosed except legally required.

8.3. Buyer must keep data updated.

9. Miscellaneous

9.1. Governed by Ukrainian law.

9.2. Disputes resolved by negotiation or court.
